Yup sure...

This was my second court appearance.... let me tell you a story

3 years ago I told my husband that if he didn't quit drinking I would divorce him. 9 weeks later the message sank in and he did quit drinking. When he was sober (as is with most drunks) he was a lovely man, when he was drunk (and still able to stand) he was plain nasty. A couple of times he went for me, but those who know me, know that I am on the large side and know how to use by bodyweight to lift large weights or to become an immovable object. He never did hurt me other than to scratch the back of my hand once.

So forward to last March, he sat me down and told me we were going to get a divorce, that I was the one who was going to leave and that I would be leaving our children in his care and all my assets behind. He would not provide me with any alimony either. So I took advice and that advice was to raise the divorce petition. I did that and he raised one also. He told me that I didn't get it, I was not divorcing him, but he was divorcing me. My petition was further along than his, our respective lawyers got together and husband finally drops his petition.

The next thing that happened is husband decides that he will apply for "residency" of the children... that is to say that he will become the main carer for the children. He attempts to get an order to have me thrown out of the house within 14 days. The judge refuses asking for a Cafcass report (www.cafcass.gov.uk). 16 weeks later, here we are at the hearing to discuss the contents of that report.

The report finds that I should remain main carer and that I should remain in the house with the children with husband living nearby for ease of access. Husband is furious. He states the report is flawed and he does not accept its recommendations. Judge points out the various routes open in the event of dispute, the one that made husband's jaw drop and go bright red was the fact that it would take at least 9 months to go down that road as there has to be secondary reports and then everyone has to give evidence.

Oh did I mention that I have refused to move out and husband refused to move out? No? Ok, well we have been living in the same house, sharing the same bedroom since this all started.

Judge mentions mediation. I am all for mediation, husband didn't want mediation.... but then his solicitor whispered to him that it would be seen as obstructive not to take mediation so he is now going for mediation. We go back to court in February with the results of the mediation.

After the court hearing, husband asks to talk to me privately. He says he cannot wait 9 months, he wants it solved now. He therefore is going to leave and continue to pay the mortgage and go and live with his elderly mother. He states he cannot get on with his mother, but he has decided on this course of action to reduce the amount of time he has to live with me.

On explaining all this to my parents, their only comment was "why is he so twitchy about 9 months?" :devil:

So it's not over yet, but it looks like husband is going to accept the inevitable and allow me to finish bringing up our kids in peace.

Yes, because I am such an awful mother, he cannot imagine how the cafcass officer couldn't see through my web of deceit :rolleyes:

Perhaps it was the cafcass officer doing a few sums on how many hours there are in a day, how many of them he spends out of the house at work or at leisure and how much work it takes to keep up with 2 kids constantly trashing the house. Or perhaps it was his constant whining about how bad I am and not alot about what the kids need... who knows?
