Yes, the sale of the picture does include those items, that is his problem. A picture can't include any physical item. Portray, display, represent, show. All good. Include implies a physical presence. Poor grammar on his part.
On another note, why the hell can't you report auctions to ebay? A real group of asshats run that site.

Yeah, I know, and it's pathetic what they try to pitch to people, I associate em in the same group as the guy with X-box, just a-holes trying to take advantage of knaive people, this one imparticular just pissed me off because of how blatantly he was trying to gyp em, hell after sifting through Ds after Ds, I nearly missed his "fine print".

The last of these I saw, the "buyer" of a 1,000$ laptop picture offered the seller a photocopy of a voided check as payment. He seemed to think it was fair, no word on what the seller thought.
