Even if they do find specific examples of their source code in the Linux kernel, it appears SCO may not even have a leg to stand on.

According to a settlement between Unix Systems Laboratories (USL) and the University of California unearthed by Groklaw, developers have broad redistribution rights over much of the Unix source code at the heart of SCO's litigation efforts. The agreement, signed in 1994, settled a number of lawsuits between USL and the U of C over the ownership of the Unix source code. SCO later acquired many of USL's Unix assets, most of which are at the center of SCO's claims that Unix source code was illegally copied into Linux.
