I think papasmurf hit the nail on the head. The polititians either don't know or were unfortunate enough to incorrectly word the law so that it didn't discriminate between gambling games and normal fun games that just steal your time.
I remember when (I think it was in Chicago) a judge wrote that games hold no speech worth preserving by the first amendment and he compared (I think it was) scrabble to modern video games.
It's clear that people like these are ignorant of what todays games are and what tomorrows games can be.
