I don't understand why she or anybody who thinks that's wrong is ignorant or an idiot. I guess I must be ignorant and idiotic too then because i'm with you on this one too Jungleman. I think that company is ripping people off. $9000.00 for internet usage? That's absolutely insane! What does she have to show for her $9000.00 investment? Nothing. It's ridiculous that a company in today's high-tech world thinks they can still get away with crap like this. And btw, to say she's been ripped off is an understatement. She needs a lawyer and sue the hell out of that company.

She signed up for an expensive DSL account. Mistake #1.
She did not understand her TOS fully, and made some grossly uneducated assumptions. Mistake #2.
She installed P2P software, without understanding the dangers there-of. Mistake #3.
She left it running all the damn time. Ignorance is no excuse. Mistake #4.
She has no legal ground to stand on, none at all.

Everyone installs and runs P2P software. It doesn't even matter what dangers can occur from P2P software because none of those happened to her (i.e. hacking, virus, etc.)

So anybody who leaves P2P running all the time is now considered ignorant? What happens when you're downloading a 1gb+ file over a slow dsl line? You're going to end up leaving that thing running over-night possibly. I'm just trying to figure out how a person is ignorant just because they're using the service they signed up for and pay monthly for. I mean, how is this considered ignorant, or uneducated, etc.?
She has no legal ground to stand on, none at all.
Maybe, maybe not. I think the legal grounds she has to stand on are this:
1) She's already paying $65.00 p/month for dsl service. What extra good or service is she paying for with the $9K? Where is the value for her money here?
2) Yes there was a service contract that she should've read more carefully. But imo, her isp shouldn't be collecting $9K for uploading files, the company that provides the p2p service should collect that money if anyone does.
3) Nobody is perfect, and we all make innocent mistakes. I think a court would sympathize and not make her pay that ludicrous amount.

I don't use p2p software... and Web, this is Australia, with australian laws, a monopoly on telephones... their system is a shambles.
Its been widely reported in Australia, this woman must have kept her head in the sand.
Yah its great to be in US were consumer power works, elsewhere it doesn't and it sucks!
PS the aussies even have dialup caps - they get charged for everything - upload and download - even the characters sent and received for a lowly irc connection...

I agree with Cameron that she should have been more careful but its wrong...so wrong on Telstra's behalf.
and Web..You cant shop around....in some areas telstra is all that is available and as they own the lines and stuff...any other isp buys off Telstra so it stands to reason that they are more expensive......
