Same idea, but Machodkis has the "official" answer I was looking for.
He gets the 3 points for indicating Dec. 31 as the birthdate.
Having it on Dec. 30 of the first year would make him 9from that day until the Dec. 30 of the following year, where he would then turn 10.
With a birthday on the 31st, the statement then reflects being 9 on the 30th.
