I think it was a dodgy driverin windows I reformatted it and is working fine now I did some googling and that also turned out some results suggesting this.
Funny issue though...

It could be that the SATA cable is not quite attached properly... make sure they are firmly attached... and the power supply has enough oomph to run everything.
