    Question Is there a law?

    Is there a law that says that if you work more then 40 hours a week then you must be payed over time, just curious, i don't think there is though. If state matters I live in FL. Thank You

    in ohio its any time over 40 in 1 WEEK is overtime (so in other words, you work 50 one week and 25 the next, its still 10 over)

    Usually void if you are a contract employee with a salary as opposed to an hourly employee....

    Yep the Great Wise Sowulo is absolutely correct. If you are salary exempt then OT does not apply. If you are hourly or salary non exempt then OT applies. Also union and non union wages may be affected depending on the type of work and contract.

    I'm straight salary exempt management so I get no OT , but they make it up to me by letting me work extra hours to feel extra special good about myself .

    The last time I looked the Federal Department of Labor stated that it was after 40 hours the employer was forced to then pay overtime at the rate of time and one-half. As stated above this is not the case if you a are a salary employee. This might also be different if you work for a state or local govermental agency. Under the the govermental guidelines they technically do not have to pay you overtime until after 48 hours. If you are a union empolyee (even though Florida is a "right To Work" state) your union contract may be different.

    Luckily, I got a generous boss, who pays not only OT for anything over 40 a week, but he pays OT for anything over 8 in one day.......I have had checks already with like 37 hours, plus 2 overtime hours!!!!

    In FL, if you are an hourly employee, you are entitled to time + 1/2 for every hour or fraction of an hour over 40 per week.

    If you are a salaried (like me) employee or a contractor, you do not qualify for time + 1/2.

    Pretty sure here in Ia, unless you are salary, it's a law, so this geekgirl rakes in the overtime!

    Here in Kansas, I found that it dependant on the paycheck timeline.

    Ie: If you have a paycheck every 2 weeks, and the company is open for 6 days a week, overtime would start after 88 hours. Kinda sucks.

    Again - depends on the state

    whoa - I take that back - from Stanley's link - it IS over 40 in a workweek. I'm getting screwed!



    "Unless specifically exempted, employees covered by the Act must receive overtime pay for hours worked in excess of 40 in a workweek at a rate not less than time and one-half their regular rates of pay. There is no limit in the Act on the number of hours employees aged 16 and older may work in any workweek. The Act does not require overtime pay for work on Saturdays, Sundays, holidays, or regular days of rest, as such."
