Looking at Felten's article from the link provided it would seem that https would be illegal too since the website is concealed from your ISP by encryption.

I'd love to see the state-house and other state/federal websites take down their firewalls. I'll set my watch to see how long it takes before the congressional servers get taken down.
But working at a bank, we're federally mandated to HAVE a firewall. Oh - what to do!
