I don't have an account with them and I don't live in texas. In my case their attempts stopped completely after I called them.
For the legal action, it is difficult to get it done successfully if you do not have sustained a damage, not even on privacy matter since they were not successful in braking the firewall. All what a law suit could do in this case is to give them a warning, not even the FBI would pursue the matter any further. It is cheeper and faster to give them a call.
I wonder how many other people are subjected to these attacks, from that bank and from others.
